JAY PAGES JIU-JITSU & MMA, LLC – TERMS, CONDITIONS, AND LIABILITY WAIVER
This document constitutes a binding agreement between the member/participant (“Member”) and JAY PAGES JIU-JITSU & MMA, LLC (“Academy”). By enrolling, training, or entering the premises, the Member (and their parent/guardian if a minor) agrees to be bound by these terms.
1. LIABILITY WAIVER, ASSUMPTION OF RISK, AND INDEMNIFICATION
1.1. INHERENT RISKS: The Member acknowledges that participation in Brazilian Jiu-Jitsu, MMA, Muay Thai, Wrestling, and related combat sports (“Activities”) involves significant, inherent risks of injury, including but not limited to concussions, broken bones, ligament tears, permanent disability, paralysis, and death.
1.2. RELEASE OF LIABILITY: The Member hereby releases, waives, and discharges the Academy, its owners (including Jay Pages), instructors, employees, agents, and property owners from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained by the Member while on the premises or participating in any Activities, INCLUDING THOSE ARISING FROM THE NEGLIGENCE of the Academy or its agents.
1.3. INDEMNIFICATION: The Member agrees to indemnify and hold harmless the Academy from any claims, lawsuits, or expenses (including legal fees) arising from the Member’s participation in Activities.
1.4. MEDICAL FITNESS: The Member warrants they are in good physical health and free of any medical condition that would increase their risk of injury. The Member accepts full responsibility for their medical status and has disclosed all pre-existing conditions to the Academy.
2. MEMBERSHIP AND BILLING POLICIES
2.1. RECURRING DUES: Membership dues are auto-debited on a recurring monthly schedule.
2.2. CANCELLATION POLICY: Cancellation requires a formal written notice submitted no less than 30 days prior to the next billing cycle. Failure to provide timely notice will result in the subsequent billing cycle being charged.
2.3. PROMOTIONAL RATE FORFEITURE: Any cancellation of membership terminates any existing promotional, discounted, or “lifetime” rates. Re-enrollment will be subject to the current standard retail pricing structure in effect at the time of re-enrollment.
2.4. ACCOUNT FREEZE POLICY: Members may request a membership hold for a minimum of 1 month and a maximum of 3 months per calendar year. Holds incur a $25.00/month administrative fee. The fee is waived only with a verified physician’s note (injury) or active military deployment orders.
3. HYGIENE AND MAT ETIQUETTE
3.1. MANDATORY UNIFORMS: Members must wear clean, appropriate gear (Gi, rash guard, shorts) for every class.
3.2. FOOTWEAR PROTOCOL: Shoes are strictly prohibited on the mats. Bare feet are strictly prohibited off the mats (e.g., in bathrooms/lobbies).
3.3. HEALTH SCREENING: Training while sick or with an active, contagious skin condition (e.g., ringworm, staph) is strictly prohibited. Failure to adhere to hygiene standards may result in immediate expulsion from class.
4. CODE OF CONDUCT AND DISCIPLINE
4.1. SAFE ROLLING: Dangerous techniques such as slamming, spiking, or “cranking” submissions without allowing a reasonable window for a tap are strictly prohibited.
4.2. RESPECT AND BEHAVIOR: Hostility, bullying, unsolicited coaching, or the use of offensive/profane language is not tolerated.
4.3. YOUTH PROGRAM PROTOCOL: The Academy employs a Three-Strike Discipline Rule: (1) Verbal warning/mat time-out; (2) Parent-coach consultation and 1-week suspension; (3) Permanent cancellation without refund.
4.4. NO SIDELINE COACHING: Parents/guardians are prohibited from coaching their children from the sideline to ensure student focus and safety.
5. GENERAL PROVISIONS
5.1. GOVERNING LAW: This agreement is governed by the laws of the State of Arizona. Any disputes shall be resolved in the appropriate jurisdiction in Arizona.
5.2. SEVERABILITY: If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
5.3. ENTIRE AGREEMENT: This document constitutes the entire agreement between the Member and the Academy, superseding all prior oral or written agreements.
